According to a CEDR survey of 50 legal specialists, organizations are now more likely to use mediation and other forms of alternative dispute resolution (ADR). Corporate counsel are increasingly seeking out mediation bodies themselves (at least for simple disputes) rather than relying on external counsel for direction.

The inclusion of ADR clauses in most contracts is a leading driver for this change. Around four-fifths of survey respondents said they used ADR clauses in contracts. Mediation was the most popular clause, cited by 62 percent of survey respondents, and, after direct negotiation, also the most favored method for resolving disputes. Only 13 percent of respondents stated they had never used mediation.
